CONSTITUTION OF THE HARYANA WHEELCHAIR CRICKET ASSOCIATION (HWCA)

PREAMBLE

We, the members of the Haryana Wheelchair Cricket Association (HWCA), recognizing the need to promote, govern, and develop the sport of wheelchair cricket in the state of Haryana, do hereby ordain and establish this constitution to govern the activities, conduct, and administration of the association and its affiliated members, ensuring the highest standards of integrity, professionalism, and inclusivity.

ARTICLE I: GENERAL PROVISIONS

  1. Name: The official name of the association shall be the Haryana Wheelchair Cricket Association (HWCA).
  2. Headquarters: The registered office shall be located in Faridabad, Haryana, or at such place as decided by the Managing Committee.
  3. Affiliation: HWCA shall remain affiliated with the Wheelchair Cricket India Association (WCIA) and the Differently Abled Cricket Council of India (DCCI), and shall abide by the regulations set forth by these national bodies.
  4. Jurisdiction: This constitution shall apply to all players, officials, coaches, zonal teams, and stakeholders associated with HWCA.
  5. Authority: Any individual registering, playing, or representing HWCA is bound by this constitution, and non-compliance may result in suspension, expulsion, or national-level bans upon recommendation to competent authorities.

ARTICLE II: OBJECTIVES

  1. To promote, develop, and regulate wheelchair cricket across Haryana.
  2. To create opportunities for differently-abled athletes and provide a transparent, inclusive, and professional environment.
  3. To organize state-level tournaments, selection trials, and training camps.
  4. To establish discipline, transparency, and fair play among all members and stakeholders.
  5. To safeguard the interests of players and officials, ensuring equal opportunities for all.

ARTICLE III: PLAYER REGISTRATION

  1. Eligibility: Any differently-abled individual willing to participate in wheelchair cricket may apply for registration.
  2. Registration: All players must complete the official registration process and agree to abide by the HWCA Constitution and by-laws laid by HWCA, WCIA, DCCI and BCCI.
  3. Rights & Privileges: Players are entitled to participate in HWCA events and represent the state in national-level tournaments.
  4. Termination of Membership: Player registration may be revoked for misconduct, violation of constitutional provisions, or engaging in anti-HWCA activities.
  5. Exit Policy: A player or official wishing to leave HWCA must submit a written resignation to the Chairperson with a notice period of at least 60 days.

ARTICLE IV: ADMINISTRATIVE STRUCTURE

  1. Governing Body (Managing Committee): HWCA shall be governed by the following hierarchy:
    • Chairperson (Final Authority)
    • President
    • General Secretary
    • Treasurer
    • Joint Secretaries
    • Zonal Coordinators
    • Team Managers
    • Players’ Representatives
  2. Decision-Making: The Chairperson’s decision shall be final in case of discrepancies or conflicts.
  3. Annual General Meetings (AGMs):
    • AGMs shall be conducted annually to review performance, finances, and future strategies.
    • Attendance of all members is mandatory.
    • A quorum of at least 51% of total members is required to validate decisions.
  4. Honoury Members:
    • HWCA may appoint selected Honoury members due to their significance and importance in the society.
    • These members do not hold any liabilities or direct responsibilities of HWCA.
  5. Advisory Board:
    • HWCA would constitute an Advisory board that would consist of various professionals and personnel that would advise and help for proficient working of HWCA.

ARTICLE V: DUTIES & RESPONSIBILITIES

  1. Players:
    • Adhere to the highest standards of discipline and sportsmanship.
    • Attend all practice sessions, matches, and official events.
    • Respect the officials, coaches, and fellow players.
    • Do not engage in anti-HWCA, anti-Haryana or anti-team activities.
    • Follow all instructions of HWCA carefully.
    • Do not bring any bad fame to HWCA or Haryana State.
    • Maintain best standards of conduct throughout the matches and tournaments.
  2. Officials:
    • Ensure smooth conduct of events and enforce the constitutional guidelines.
    • Maintain transparency and fair treatment of all players.
    • Report to the Chairperson and execute assigned responsibilities diligently.
  3. Zonal Teams:
    • Conduct regular practice sessions and report performance updates to the HWCA.
    • Identify and nurture emerging talent within their zones.
    • Ensure equal unbiased division of resources among all players.
    • Ensure compliance with HWCA guidelines.
    • Report any anti-team or anti-Haryana activities happening in zone to HWCA.

ARTICLE VI: DISCIPLINARY CODE

  1. Code of Conduct: All members must uphold the values of respect, integrity, and professionalism.
  2. Behavioral Disqualifications:
    • Any player or official found guilty of misconduct, insubordination, or anti-team activities shall be subject to disciplinary action.
    • Any player or official found guilty of any anti-HWCA, anti-Haryana, anti-Wheelchair Cricket, anti-WCIA, anti-DCCI or anti-team activities shall be subject to strict disciplinary action.
    • Guilty officials and players would be imposed a ban as per the decision of the Managing Committee.
    • Waiting period or suspension may also be imposed as per the degree of indiscipline of the player.
    • Repeated offenses may result in a lifetime ban.
  3. Ban Policy: 
    • Violations may lead to suspension or permanent expulsion from HWCA.
    • Recommendations may be made to WCIA and DCCI for a national-level ban.

ARTICLE VII: PLAYER ENTRY & EXIT BY-LAWS

  1. Entry Requirements:
    • Submission of medical proof of disability.
    • Successful completion of HWCA’s official selection trials.
  2. Exit Procedures:
    • A formal resignation letter addressed to the General Secretary or President.
    • Clearance of all dues and obligations.
    • Completion of Waiting Period or Buffer Period or Notice Period or Cooling Period imposed by HWCA.
  3. No Objection Certificate (NOC) Procedure:
    • Player may apply for exiting HWCA and securing No Objection Certificate to enter other state’s association as per WCIA and DCCI by-laws.
    • Player needs to complete the waiting period mentioned in NOC completely before representing any other body at district/state/national level. This waiting period is imposed to remove the direct conflict-of-interest by the exiting player and also to cover the losses that would occur in future from issuing this NOC to the player.
    • Player needs to apply for NOC at least three months prior to any state or national level event in which the player needs to participate representing other state’s body.
    • The player also needs to handover all the trophies, medals, shields and all the property that belongs to the Haryana state team before applying for NOC.
    • Player needs to clear all dues and obligations before applying for NOC.
    • Recommendations may be made to WCIA and DCCI directly for a national-level ban if these NOC conditions are disrespected and not followed.
  4. Suspension & Expulsion:
    • The Managing Committee holds the authority to suspend or expel any player or member violating the constitution.

ARTICLE VIII: FINANCIAL MANAGEMENT

  1. Funding Sources: HWCA shall raise funds through sponsorships, grants, donations, and membership fees.
  2. Financial Audits: Annual audits shall be conducted to ensure transparency.
  3. Utilization: Funds shall strictly be used for the development and promotion of wheelchair cricket in Haryana.
  4. Rewards Management: All the rewards for team winnings belong to HWCA directly. Distribution of such rewards would be done by Managing Committee among participating members judicially after meeting or deducting the related expenses.
    Individual rewards for individual achievements belong to the players directly.

ARTICLE IX: RESOURCE, MEDIA AND ASSETS MANAGEMENT

  1. Resources: HWCA shall have complete rights over the resources of the Haryana State Team.
  2. Media: HWCA shall have complete rights over photos, videos, records, achievements, clips, news articles and all related media of all the players of Haryana. HWCA is free to use them however and wherever they want.
    Considering the nature of Cricket sport as it a team event and not an individual sport, even after a player retires or exits HWCA, the resources and media during the time frame of player’s association with Haryana State Team are all HWCA’s property and cannot be used by the player in individual capacity later on.
  3. Assets: HWCA shall have complete rights over all the assets of the association such as playing kits, playing wheelchairs etc.

ARTICLE X: AMENDMENTS TO THE CONSTITUTION

  1. Amendments to this constitution may be proposed during AGMs and shall require a two-thirds majority vote.
  2. Any modifications must align with the objectives and ethical standards of HWCA.

ARTICLE XI: DISSOLUTION

  1. In the event of dissolution, HWCA’s assets shall be transferred to another charitable sports organization working for differently-abled individuals.
  2. The dissolution decision must be ratified by a two-thirds majority of the General Body.

DECLARATION

We, the members of the Haryana Wheelchair Cricket Association (HWCA), hereby adopt and abide by this constitution, ensuring fairness, transparency, and excellence in wheelchair cricket. A player after filling in and accepting the terms and conditions of becoming a part of Haryana Wheelchair Cricket Association (HWCA) automatically agrees to accept and follow HWCA’s Constitution as well.
